Brest Regional Court turns down complaint against local officials
On 18 October, the Judicial Panel for Civil Cases of Brest Regional Court dismissed a complaint by Dzianis Turchaniak, local coordinator of the For Freedom opposition movement, who had urged the Court to redirect his complaint against the administration of Brest Leninski District for consideration by an inferior court.
It all started when Dzianis Turchaniak tried to find out how local election commissions were formed, while some of the nominees were denied membership without nay explanations (including the activist himself).
The administration of the district ignored the activist’s request, who then lodged a complaint with the Court of Leninski District, as the officials violated the Code on Public Appeals. However, the Court refused to consider the case, saying that it was beyond the Court’s legal competence.
The Regional Court also saw no violations in the actions by the officials of the district’s administration and dismissed Mr. Turchaniak’s complaint. By doing this, the Court ignored the fact that the activist was deprived of his right to access to information on the activities of government bodies.
Dzianis Turchaniak says he is going to appeal the decision at the Supreme Court.
